Marvel sues NCSoft and Cryptic Studio about City of Heroes

Apparently the conflict has started because Marvel felt that the customizing possibilities for the heroes' costumes in CoH allowed players to plagiarize (sp?) their heroes... and as PlayNC is hosting the game, and Cryptic is the developper, they're both the targets of this sue.

Heh i saw many people who ripped off superheroes in COH. Next Funimation will sue because people ripping dragonball z characters in the game probably.

Yeah, it's true. Players can make very Marvel character-like characters in CoH. It definitely gives them the power to plagurize.

But that's not as bad as what the Bic company does!

Bic makes this technology call a "pen" that you can use to draw any Marvel character you want! OMG!

Giving people the technology to copy something is not bad in itself. There are cases where technology is prohibited by law when that technology has no legitimate use, but CoH certainly does not fall into that category.

Moreover, if I draw my own picture of Spider Man on a napkin and show it around, but it's for my own personal enjoyment and not something I plan to market or use for any kind of promotion, then it's hard to think I've violated Marvel's trademark. Making a Marvel-like character in CoH strikes me as a similar situation. As a player, I'm making my own character for my own enjoyment, and yes other players can see it (it's a multiplayer game, right? Haven't tried it.) If the developers had put a Spider Man character right in it themselves, that would be another story. It's the difference between Bic selling a pen with an unauthorized picture of Spider Man on the package and simply selling a pen that somebody might use to draw Spider Man himself.

And there's this: If a lot of CoH players are using Marvel-like characters, I am not at all convinced that this does not actually help Marvel in a number of ways. It's like free marketing. A few months ago they were paying megabucks to to put the image of Spider Man everywhere we looked, trying to get it burned into everyone's mind so that we'd want to see the movie (and presumably buy the comic book, the T-shirt, and so on...) I could hardly leave my house without seeing an image of Spider Man somewhere, and that didn't come cheap. Now someone is doing it for free, and Marvel...is mad about it?
