Is downloading music legal or illegal? Heres some interesting info I saw. :D

crap... even the official ftp server of my internet provider is illegal lol... only coz ppl share... :/

there was an interesting article published by german heise.de, that stated that most stuff, thats being pirated on the internet adds to the "products" popularity, and wide-spread, obviously.

as with musicians, they dont really win anything directly.
But like Soli stated, about 80% of musicians make money by merchandise, tours, concerts, etc....
and they actually GAIN profit indirectly thru pirated music.
also about 35% of asked musicians stated they would like music downloads to be free.

I did my senior project on filesharing and copyright law. We focused on music specifically. The gist of it is, yes, the record labels are the ones who lose money directly from the albums. But most artists recording costs are taken from their own cuts of the profits coming in. Should they not sell enough to recover the costs, the label will either take their live show profits (which is where the artist typically makes ANY money) or sue them.

well JJ, you are musician yourself.

If I were a pro musican, I wouldnt really give a darn, because they earn like 0.01$ per sold CD, while the record company (aka label) earns like 5$.

The thing is, with music (and games) you're not buying to product itself, you're buying the right to listen to (or play) it. So, sure, that right is yours, and you can do whatever you want with that right (or perhaps 'liscence' is the better word) including give it to a friend-- but it's when you start spawning liscences (i.e. giving your friend the music for free) that problems start. With downloading music, there's less of a clear line, but it's not 'it's mine so i can do whatever with it' that applies.

If it wasn't so friggin expensive people wouldn't download it the whole time.
Over here it's like £12 for an album...

The new napster and iTunes stuff is a good start, but you need credit card details for that.

one Example of buying a product and NOT owning it fully... Steam and Half Life 2.

even after you have bought the game, you still need to log onto their servers to " authorise" and "unlock" the game so you can actually play it..

also your Log in with steam is locked to your cd-key so if you sell the game to a friend. You have to PAY steam to transfer the cd-key which is locked to your login, to his so that he can play.

its still theft :P they earned the money. they made the music and have the right to charge what they like for it.

YES i download music but keep in mind that you cant find everything you need on shops ;)
so...
copying for profit is illegal.
sharing for nothing is legal.
sharing the stolen(hacked etc, this applies to software as well) music is illegal x2 :)

The article made for an interesting read and confirms everything that I've heard in the past. You can DL music and other media so long as you do it legally. For example a lot of the mp3's I have on my comp I have ownership rights over becuase I also own the cd. I'm just to lazy to rip and mp3 from the cd's because it's often quicker to DL the song instead. Just be smart about what you're sharing and DL'ing and you shouldn't have anything to worry about :)

yeah, in fact theres a lot of misinformation about music that is to be downloaded. if its covered by the copyleft, then its all cool.
Some german bands eg. have legally allowed people to copy their material.
