Correct me if I'm wrong, but the major part of the conviction was that he distributed pirated games on the HDD he fitted into the modded console. It would be pretty hard to convict someone for simply adding a mod chip or HDD, I hope. I mean, once you own the hardware you can basically do what you want with it.
