Incredibly stupid yes. And he should not have done it but its not as bad as it first sounds. The flight was to chicago which is longer than 8 hours. Any flights over 8 hours requires that their be three pilots. So after 8 hours his intoxication would most likely have been definitely gone. That's enough justification.
