That doesn't change the fact that witness statement are evidence. If it went to trial the jury would be free to make of it what they will. I think his story is credible.

You can't PROVE he had cannabis in the first place. He may just be lying in order obtain some for 'free'. Stranger things have happened.

Witness testimony is introduced as evidence in court all the time.

I'm thinking they just felt sorry for someone that utterly clueless. :D Plus, a consideration in charging someone with a crime is whether there's a reasonable chance of conviction, and I'm not sure a jury would convict this guy no matter what the law says.
