lmao Fizz - vacant possession may just be a British thing - under the standard conditions of sale implied into standard contracts, special condition 5 provides that the property is sold with vacant possession on completion, or it is sold subject to those leases or tenancies set out in the contract - whichever is appropriate is deleted; vacant possession is merely an insurance that the property will be properly vacated by those living there in time for the completion date and so that the buyer can take up residence. The problems that arise are when there is a lease that is not referred to in the contract (as in my case) - (full details have to be given)or if there are any other occupiers who may have an equitable interest in the property, if there is such an interest then it must be released by the person holding the interest in writing or preferably, by joining them to the contract to release their interest - basically i know most of the stuff about other occupiers etc. but i don't know the position if there is no reference to the lease in the contract for sale; and i need to know it for the examination tomorrow (i've been given preliminary information detailing the contract and i have got office copy entries showing that there is a lease registered but there is no such reference in the contract itself). As you can probably tell from all that waffle i am extremely bored and i have absolutely no idea when it comes down to the stuff i need to know - i think that resits beckon  - oh well _______________ Support bacteria, they're the only culture some people have. |

Macromedia puts a ton of extra crap in their html that some speculate that Macromedia uses for marketing purposes.
